1. Acceptance of Terms
By downloading, installing, or using Quibu ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
The Quibu desktop application can be used without an account. By creating an account for cloud features, you additionally agree to provide accurate account information and to keep your credentials secure.
2. Description of Service
Quibu is a worldbuilding and writing editor for fantasy authors and game masters. The Service includes:
- Desktop Application (Free): A local-first editor with full offline functionality, including lore management, maps, timelines, story editing, and TTRPG tools. No account required.
- Cloud Services (Paid): Optional subscription tiers that add cloud sync, sharing, collaboration, and AI-powered features.
3. User Content & Intellectual Property
You own your content. All stories, lore, maps, images, and other creative works you produce using Quibu remain your intellectual property. We claim no ownership over any content you create.
By using cloud sync, you grant us a limited license to store and transmit your content solely for the purpose of providing the Service (synchronization, backup, and AI features you initiate). This license terminates when you delete your data or close your account.
By using sharing features, you acknowledge that shared content will be accessible to anyone with the share link. You are responsible for what you choose to share.
4. AI-Powered Features
Certain subscription tiers include AI features powered by third-party models (currently OpenAI and fal.ai). When you use these features:
- Relevant portions of your project content are sent to the AI provider for processing.
- OpenAI does not use API inputs or outputs to train or improve its models unless the API customer explicitly opts in to data sharing. Quibu does not opt in to that data sharing.
- Quibu disables OpenAI Responses API application-state storage. OpenAI's standard abuse-monitoring logs may still retain customer content for up to 30 days unless the Quibu OpenAI project has approved Zero Data Retention or Modified Abuse Monitoring enabled. fal.ai request history is disabled for concept-art generation, and generated media is set to expire after one hour. Original project data remains stored on our servers.
- AI-generated content (text, images, suggestions) is provided "as is" and may contain errors. You are responsible for reviewing and editing AI outputs.
5. Subscriptions & Billing
Cloud features require a paid subscription. By subscribing, you agree to:
- Pay the applicable fees for your chosen tier (Sync, Studio, or Grimoire) on a monthly or annual basis.
- Automatic renewal at the end of each billing period unless you cancel before the renewal date.
- Price changes will be communicated at least 30 days in advance.
All payments are processed by Stripe. Refund requests are handled on a case-by-case basis — contact us within 14 days of a charge if you believe a refund is warranted.
If you cancel your subscription, you retain access to cloud features until the end of your current billing period. After that, your data remains stored for 30 days to allow re-subscription. The desktop application continues to function fully offline regardless of subscription status.
6. Acceptable Use
You agree not to use the Service to:
- Upload or share content that is illegal, harmful, or violates the rights of others
- Attempt to access other users' accounts or data
- Reverse-engineer, decompile, or attempt to extract the source code of the Service
- Use automated systems (bots, scrapers) to access the Service in a manner that exceeds reasonable use
- Circumvent usage limits, rate limiting, or other technical restrictions
- Resell or redistribute the Service without our written consent
We reserve the right to suspend or terminate accounts that violate these terms.
7. Availability & Disclaimers
The desktop application is designed to work offline and does not require an internet connection for core functionality. Cloud features require an active internet connection.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that cloud services will be uninterrupted, error-free, or free of harmful components.
We make reasonable efforts to maintain uptime and data integrity but are not liable for temporary outages, data loss due to unforeseen circumstances, or issues caused by third-party services.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Quibu and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or interruption of business, arising from your use of or inability to use the Service.
Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
9. Governing Law
These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or the Service shall be resolved in the courts of competent jurisdiction within the United States.
10. Changes to These Terms
We may modify these Terms at any time. Material changes will be communicated via our website or email. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
